Terms of Service
Last updated: October 22, 2026
These terms are an agreement between you and Michael Albrecht, doing business as FirstGoal ("we", "us") for your use of FirstGoal at startfirstgoal.com (the "Service"). By creating an account or using the Service, you agree to these terms and to our Privacy Policy. If you don't agree, please don't use the Service.
1. Your account
- You must be at least 13 years old to use the Service, and old enough to form a binding contract where you live to buy a subscription.
- Give us an accurate email address and keep your password secure. You're responsible for activity under your account.
- Tell us right away at brightmdapps@gmail.com if you think someone has accessed your account without permission.
2. Subscriptions, free trial and billing
- Plans: FirstGoal is offered as a subscription for $3.99 per month or $39.99 per year, plus any applicable taxes. Prices shown at checkout control.
- United States only: subscriptions are currently available only to customers with a billing address in the United States. If a subscription is started with a billing address outside the US, we cancel it right away and refund any payment in full.
- Free trial: new accounts get a 14-day free trial with full access, and no payment method is needed to start it. If you subscribe during the trial, you keep the remaining trial days and are first charged when the trial ends. If you don't subscribe, your account becomes read-only when the trial ends: you can still view, export, or delete your data.
- Automatic renewal: subscriptions renew automatically at the end of each billing period until you cancel. You authorize us (through our payment processor, Stripe) to charge your payment method on each renewal.
- Cancelling: you can cancel any time from your account's billing page. Cancellation takes effect at the end of the current billing period, and you keep access until then.
- Refunds: payments are non-refundable and we don't give credits for partial periods, except for the automatic credit when you switch plans or where required by law. If something went wrong, contact us — we'll do our best to make it right.
- Price changes: we may change prices. We'll tell you in advance, and a new price applies only from your next renewal after the notice. If you don't agree, you can cancel before then.
- Failed payments: if a payment fails, we may pause or end paid access until it's resolved.
3. Not medical, financial or professional advice
FirstGoal is a personal goal and task tracker. It does not provide medical, health, fitness, financial or other professional advice, and nothing in the Service creates a doctor–patient or other professional relationship. Targets, suggested amounts and progress calculations are estimates for your own planning. Talk to a qualified professional before making health, fitness or financial decisions. Don't use the Service to store other people's health or patient information.
4. Your content
You own the goals, entries, tasks, notes and other content you put into the Service. You give us permission to store, process and display it only as needed to run the Service for you. You can download or delete it at any time (see the Privacy Policy).
5. Acceptable use
You agree not to:
- break the law or infringe anyone's rights using the Service;
- try to access other people's accounts or data, or probe, scan or test the Service's security without permission;
- interfere with or overload the Service, or use bots or scripts to access it other than through normal use;
- copy, resell or reverse-engineer the Service, except as the law allows.
6. Availability and changes
We work to keep the Service available and your data safe, but we don't guarantee it will always be available, uninterrupted or error-free. We may change, add or remove features. If we ever discontinue the Service, we'll give reasonable notice so you can download your data, and refund any prepaid time you couldn't use.
7. Ending your account
You can delete your account at any time in Settings. We may suspend or close accounts that violate these terms or that we reasonably believe put the Service or other users at risk; where appropriate, we'll tell you why.
8. Disclaimers
To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.
9. Limitation of liability
To the fullest extent permitted by law, we won't be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim, or $50. Some places don't allow these limits, so they may not apply to you.
10. Indemnity
You agree to defend and hold us harmless from claims arising from your misuse of the Service or your violation of these terms.
11. Governing law
These terms are governed by the laws of the State of Kansas, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Kansas, unless the law where you live gives you the right to bring it elsewhere.
12. Changes to these terms
We may update these terms. For material changes, we'll update the date above and notify you by email or in the app before they take effect. Continuing to use the Service after that means you accept the updated terms.
